CoPulse Privacy Policy

This Privacy Policy describes how Apex Health Network, Inc. ("Company," "we," "us," or "our") collects, uses, and shares information through the CoPulse mobile application, website, and related services (the "Services").
1. Information We Collect
A. Information You Provide
- Account information (email address, username, profile details you choose to provide)
- Communications with us (support requests, feedback)
- If you win a prize and choose to claim it, we collect the tax information, eligibility confirmations, and claim records needed to process that prize. You cannot submit tax information before winning, and you do not have to claim a prize.
B. Information From Connected Devices and Services
If you connect third-party services (such as Apple Health, Samsung Health, Google Health, Garmin, WHOOP, Oura, or Polar), we may collect data you authorize, which may include:
- Activity and workout summaries
- Cardiovascular activity metrics
- Resting heart rate (RHR)
- Heart rate variability (HRV)
- Sleep duration, sleep consistency, bedtime, and wake time
- Other wellness or recovery-related metrics where available
C. Automatically Collected Information
- Device and app information (device type, operating system, app version)
- Usage information, including app sessions, onboarding progress, connected-provider type, and use of social and contest features
- Diagnostic information, including app route, version, device environment, crash reports, and technical error details
2. How We Use Information
We use information to:
- Provide, operate, and maintain the Services
- Generate insights, summaries, and recommendations
- Enable health sharing with audiences you select and score contests when you enable Health Sharing & Contests
- Administer free-entry contests and, only when a winner chooses to claim a prize, verify eligibility, process the claim, deliver the prize, and meet related tax obligations
- Maintain security, prevent fraud, and enforce our Terms
- Improve and develop the Services
3. Consumer Health Data Privacy
This section is our Consumer Health Data Privacy Policy. It applies to health and wellness information that identifies or can reasonably be linked to you.
A. Health Data We Collect and Sources
We collect the health data categories described in Section 1 from information you enter and from device or service connections you authorize, including Apple Health, Samsung Health, Google Health, Garmin, WHOOP, Oura, and Polar. Depending on the connection, this can include heart rate, HRV, resting heart rate, stress, sleep and sleep stages, activities, workouts, provider device details, and CoPulse-derived recovery, sleep, and load metrics.
B. Why We Collect and Use Health Data
We use health data to sync connected records, show your private history and insights, operate features you request, maintain data integrity and security, and, only when Health Sharing & Contests is enabled, share selected metrics with eligible social audiences and calculate contest results.
C. Health Data We Share
We may disclose health data as follows:
- To accepted friends, team members, and event participants, in the limited metric and leaderboard views enabled by Health Sharing & Contests
- To companies that process data on our behalf only as technically necessary to operate and secure the Services
- As required by law, or to investigate fraud, abuse, security incidents, or contest-integrity issues
We do not sell consumer health data, use it for targeted advertising, or permit service providers to use it for their own advertising. We do not use geofencing around health-care facilities to identify or infer health information.
D. Your Health-Data Choices
Connecting a wearable is optional. Before a connection, the CoPulse interface identifies the categories requested and the reason for the request; the provider or operating system also presents its permission controls. You may disconnect a provider or delete its CoPulse data from the account device controls.
Health Sharing & Contests is off by default. Enabling it turns on friends, teams, chats, lobbies, health sharing, and contest participation.
Share Sleep Timing is a separate optional setting. If you enable it, eligible friends and teammates may see the bedtime and wake time associated with a shared day. Turning off Health Sharing & Contests also turns off Share Sleep Timing.
You may turn the setting off at any time. This hides you and your existing social connections from social features and removes you from active lobbies. While it is off, your contest identity is masked, your displayed contribution is zero, and you cannot receive a prize share at finalization. If you turn it back on before finalization, the next scoring update recalculates eligible data across the full event period, including dates while the setting was off. Turning it back on also restores existing friendships and team memberships where possible. You may request access, correction, or deletion through the app or by emailing support@copulse.io. We may retain limited contest and security records and, if you claimed a prize, the related records required for tax or other legal obligations.
CoPulse's use of information received from the Google Health API adheres to the Google Health API Developer and User Data Policy, including its Limited Use requirements.
4. Privacy, Visibility, and Social Sharing
A. Default Privacy
Users may use CoPulse with their data remaining private to:
- The user
- The Company
- Companies processing data on our behalf only as needed to operate and secure the Services
B. Friends, Teams, and Events
Social features require Health Sharing & Contests. When enabled, certain high-level metrics may become visible to eligible friends, team members, and event participants. These may include:
- HRV and RHR
- Sleep hours and sleep consistency
- Bedtime and wake time when you separately enable Share Sleep Timing
- Cardiovascular activity summaries
- Other aggregated or high-level performance indicators
Turning Health Sharing & Contests off disables social features and hides your friendships and team memberships without deleting them. Turning it back on restores them where possible.
C. Public and Private Profiles
- Your profile does not appear in social search or social lists while Health Sharing & Contests is off.
- Health metrics are shown only through eligible social and contest relationships while the setting is enabled.
5. We Do Not Sell Your Data
We do not sell personal data or health/activity data to third parties. We use data solely for operating, improving, and supporting the Services and related business purposes.
6. Service Providers, Analytics, and Diagnostics
We use companies that process information on our behalf to operate and secure the Services, authenticate users, and diagnose technical problems. If a winner chooses to claim a prize, companies acting on our behalf may also help process the claim, related tax documentation, and prize delivery. They may process information only for those purposes and under applicable agreements.
We use limited product analytics and technical diagnostics to understand feature use and fix failures. We do not intentionally include raw health measurements in analytics or diagnostic reports.
7. Data Retention and Deletion
We take reasonable steps to honor deletion requests.
If you delete your account:
- We will delete or de-identify personal account data where reasonably possible.
- You may be removed from teams, clubs, or events going forward.
- Historical records (such as past event results, leaderboards, or aggregated statistics) may remain and may not be fully removable.
- If you choose to claim a prize, we may retain the related tax and prize records for tax, fraud-prevention, audit, and other legal obligations.
- Deleting an account forfeits unclaimed prizes.
8. Security
We use reasonable technical and organizational measures to protect data, but no system can be guaranteed to be completely secure.
9. Age Requirements
The Services are not intended for children under 13 years of age, or an older minimum age where local law requires it. We require a 13-or-older affirmation during account setup and do not knowingly collect personal data from children below the applicable age. If you choose to claim a prize, you must be 18 or 19 depending on the eligible jurisdiction, as stated in the Official Contest Rules.
10. Contact and Appeals
To exercise a privacy or consumer-health-data right, email us with the account email and the request. We may verify the request before acting. If we deny a request, you may appeal by replying with "Privacy Appeal" in the subject line and explaining why the decision should be reconsidered.
